How Do I know If I Qualify for a German Pension Refund as a USA Citizen?

The Social Security Agreement between Germany and the USA states that as a U.S. citizen, you can claim a refund on your German pension contributions if you have worked in Germany for less than 5 years. This also applies to any period that you received unemployment benefits or maternity/paternity payments. Additionally, a minimum of 24 months must have elapsed since your most recent pension contribution in Germany.

How can I determine if I’ve completed 60 months of contributions?

In Germany, the pension office counts even a single day of work within a month as a full month of contributions. For instance, if you started working on January 31st, that single day’s contribution would count as your payment for the entire month of January. As a result, it would add one month to your total contribution count.

When can I return to work in Europe after applying for a refund?

As a U.S. citizen, you are allowed to resume working in Europe from the date you submitted your refund application. Even if your refund is still being processed at the time you start working in Europe, it will not impact the decision of your claim.

What will my total German pension refund amount be?

The average pension refund is approximately €11,800. However, the exact amount you’ll receive depends on your specific circumstances. Refundable contributions include:

· 100% of the pension contributions deducted from your salary during your time working in Germany.

· 50% of any voluntary contributions, such as those made through freelance work.

· Adjustments for contributions added or reduced as a result of pension equalization during divorce proceedings.

Since 2018, pension contributions have been calculated at 9.3% of your gross earnings, up to a monthly income cap (Beitragsbemessungsgrenze). Today, the cap in West Germany is €7,550. Any income above this threshold is not subject to pension contributions.

What are the costs involved in claiming my refund?

Our service fee is 9.75% of the refunded amount, which includes VAT as well as any external legal fees. There are no hidden charges or unexpected expenses. With our success-based model, you don’t pay anything upfront. Fees are only due once your refund has been successfully processed and received by you.

Do I need a German bank account to receive my refund?

No, you don’t. Refunds are processed through an escrow account managed by a German law firm to ensure security. This method helps expedite the transfer of your funds and reduces both transaction and currency conversion costs. The money will be sent directly to your preferred bank account in the currency of your choice. You don’t need to have a German bank account, and the account can be registered in someone else’s name.
